Terms & Conditions, Waiver and Release

1. Definitions — "OPTA" or "the Academy" means Olde Providence Tennis Academy, its owners, directors, employees, coaches, contractors and agents. "OPRC" means Olde Providence Racquet Club. "Participant" means the player registered for any OPTA program; "Parent" means the parent or legal guardian who registers a Participant under 18. "Program" means any OPTA class, clinic, camp, Junior Team Tennis, private lesson, tournament, match play, fitness session, travel, lodging, or related activity, at OPRC, Colonel Francis Beatty Park, or any other location.

2. Registration and Payment — Registration is complete only when the form is submitted and payment received. Spots are limited and filled in order of paid registration. Payment is due before the first day of a session or camp week; a 10% late fee applies to any balance unpaid at the session start. Non-OPRC-members pay an annual Club Registration Fee ($400 first child, $300 second, $200 third); it holds the Participant's place at OPTA for twelve months and does not grant OPRC membership. Sibling and early-registration discounts are refunded to the original card within 24 hours of full payment; only one discount applies per registration. Cash or check payments are accepted in person; a registration form must still be submitted online.

3. Refunds, Credits and Withdrawal — Program fees are non-refundable after the first day of the session. Camp weeks are non-refundable after the Monday of that week. Sessions missed by the Participant are not refunded or credited. Withdrawal for a documented injury or illness may be credited toward a future session at OPTA's discretion.

4. Weather and Cancellations — Most classes are held indoors; outdoor classes are cancelled in rain or unsafe conditions. Cancellation notices are posted on the OPTA website and sent by email or text. Junior Academy, Varsity and Elite programs have dedicated indoor courts and no weather make-ups. OPTA observes Thanksgiving Day, Christmas Eve, Christmas Day and New Year's Day; these dates are excluded from session pricing.

5. Elite Academy Recurring Billing Authorization — By registering for the Elite Academy, the Parent authorizes OPTA to charge the card on file $910 (4 days/week) or $1,100 (5 days/week) on the 15th of each month for the following billing cycle (16th to 15th), from registration through June 14. To cancel, send written notice by email at least 14 days before the next billing date; charges already processed are not refunded.

6. Supervision, Drop-off and Pick-up — OPTA supervision begins at the scheduled class or camp start time and ends at the scheduled end time. Participants must be picked up within 15 minutes of the end time. Participants under 13 must be signed in and out by a Parent or an adult named on the registration form.

7. Conduct — Participants and Parents are expected to show respect to coaches, staff, other players and OPRC members, and to follow OPRC facility rules. OPTA may remove a Participant from a Program, without refund, for behavior that is unsafe, disruptive, or abusive, including conduct by a Parent. Damage to OPTA or OPRC property caused by a Participant is the Parent's responsibility.

8. Health and Medical — The Parent confirms that the Participant is in good health and has disclosed on the registration form every medical condition, allergy, or limitation that could affect safe participation. OPTA may decline or end participation at its discretion. If the Parent cannot be reached, the Parent authorizes OPTA to obtain emergency medical treatment for the Participant, at the Parent's expense. A Participant who suffers a head injury or other significant injury during a Program will be removed from play and may return only with written clearance from a licensed medical provider.

9. Assumption of Risk — Tennis and athletic training involve risks that cannot be eliminated regardless of the care taken, including but not limited to bruises, sprains, cuts, broken bones, joint injuries, head, neck and back injuries, heat-related illness, illnesses contracted from others, and catastrophic injury, paralysis or death. The Parent, individually and on behalf of the Participant, understands these risks and voluntarily assumes all of them, known and unknown, including risks arising from the negligence of the parties released below.

10. Release and Waiver of Liability — To the fullest extent permitted by North Carolina law, the Parent, individually and on behalf of the Participant and their heirs and personal representatives, releases, waives and discharges OPTA, OPRC, Colonel Francis Beatty Park and Mecklenburg County Park and Recreation, and their respective owners, officers, directors, employees, coaches, agents and volunteers (the "Released Parties") from any and all claims for injury, illness, death, or loss of or damage to property arising from participation in or travel to any Program, including claims arising from the negligence of the Released Parties, and agrees not to sue any Released Party for such claims.

11. Indemnification — The Parent agrees to indemnify, defend and hold harmless the Released Parties from any claim, loss, liability, damage or expense, including reasonable attorneys' fees, arising from the Participant's participation in any Program, including claims brought by or on behalf of the Participant and claims for injury or damage caused by the Participant.

12. Permission to Transport — The Parent permits OPTA coaches to transport the Participant to and from tournaments, matches and Program activities, and releases the Released Parties from liability for injury, loss or death occurring during such travel, except as caused by gross negligence or willful misconduct.

13. Image Release — The Parent consents to OPTA and OPRC photographing and recording the Participant during Programs and using those images, recordings and the Participant's name for marketing, social media, website and public relations purposes, without compensation. To opt out, email OPTA before the session begins.

14. Communications — By registering, the Parent agrees to receive email and text messages from OPTA about schedules, cancellations, and Program information. Reply STOP to end texts.

15. General Terms — This agreement is governed by the laws of the State of North Carolina; venue for any dispute is Mecklenburg County, North Carolina. If any provision is held unenforceable, the remaining provisions remain in full force. This agreement may not be modified orally. It covers every Program the Participant attends during the twelve months after acceptance. The Parent certifies that they are at least 18, are the parent or legal guardian of the Participant, and have authority to agree on the Participant's behalf. Adult Participants (18+) agree to these terms on their own behalf wherever "Parent" appears.

16. Acceptance — By checking "I agree," typing my name, and submitting a registration, I confirm that I have read and understand this entire agreement, that I am giving up substantial legal rights including the right to sue, and that I agree to it voluntarily. Electronic acceptance has the same effect as a handwritten signature.
